Terms of Service

The provider of this site and your contracting party is Thomas Honold (sole proprietor), Schlesierstr. 10, 78315 Radolfzell, Germany — “we” below. FS Modworks is the brand the mods are published under. These terms apply to all accounts, memberships and downloads on fsmodworks.com.

FS Modworks offers free and membership-gated mod downloads for Farming Simulator 25. Mining Layers stays free forever; a free account is required for every download.

You register with an email address and password or via Discord. Keep your credentials secret; actions taken through your account are attributed to you until you report misuse to us. You can delete your account at any time in your account settings.

A membership unlocks member content. You choose the initial term: 1, 3 or 12 months. Lifetime is exempt from this — a one-time payment with no renewal; “lifetime” means the operating life of this platform.

After the initial term the membership continues for an INDEFINITE PERIOD. Billing continues in the cycle you chose (1 month: €3.47 monthly; 3 months: €8.47 every 3 months; 12 months: €27.47 every 12 months). No new minimum term arises from this: you can cancel at any time, including in the middle of a period you have paid for.

You may cancel at any time without notice period — in your account or via the Cancel contracts here button. Cancellation takes effect at the end of the current month; your access remains until then and nothing is charged afterwards. If you paid in advance for a longer period, we refund the unused remainder pro rata by full months. We confirm receipt to you immediately by email. Your statutory right of withdrawal (clause 7) remains unaffected.

Termination for cause. The right of either party to terminate the contract for good cause without notice remains unaffected (§ 314 German Civil Code). Good cause exists where, taking all circumstances of the individual case into account and weighing the interests of both parties, the terminating party cannot reasonably be expected to continue the contract until the agreed end. Where the good cause consists in the breach of a duty under this contract, termination is permitted only after a period set for remedy has expired without result or after a warning has remained without result. Please declare termination for cause in text form — for example by email to contact@fsmodworks.com — stating the reason. We will confirm receipt to you without undue delay by email.

The presentation of memberships and the individually purchasable 3D assets on this site is not a binding offer. By completing checkout (button labelled “order with obligation to pay” or equally unambiguous wording) you make an offer. The contract is concluded when we confirm it by email or activate the membership or the download, whichever happens first. We confirm the contract text to you by email; the contract language is German or English.

All prices are final prices in euros and include statutory VAT. The payment methods shown during checkout apply. Payment is due on conclusion of the contract; activation happens once payment is received.

For memberships with a term you authorise a recurring payment with your payment provider: first for the initial term, then in the same cycle until you cancel. We inform you by email in good time before any price change; you can cancel before the new price applies.

When you buy a 3D asset as a single purchase you pay once; no subscription and no recurring payment arises. The download remains permanently available in your account once payment is confirmed.

We supply member content by unlocking it in your account. As a consumer you have a 14-day right of withdrawal; the policy and model form are available under Withdrawal. If at checkout you expressly request immediate supply of digital content and confirm your knowledge of the expiry, the right of withdrawal expires once supply begins (sec. 356 (6) BGB).

Downloads are licensed for personal use in Farming Simulator 25. Re-uploading or redistributing outside this site is not permitted (see the rights line on each mod). The rights to the mods remain with their authors.

In particular, any transfer to third parties and any making available to the public is prohibited — such as uploading to download portals, file-sharing services, Discord servers or other websites. Every download key carries a personal identifier tied to your account. In the event of a breach we block the account's download keys; the right to extraordinary termination (clause 4) remains unaffected.

In the event of a breach of the redistribution ban we may claim a reasonable contractual penalty, set by us taking into account the nature, extent, duration and culpability of the breach and subject to judicial review in case of dispute; it amounts to no more than EUR 5,000 per breach. Further claims for damages remain unaffected; a paid penalty is credited against them.

If the distribution takes place in the course of business — in particular by sale, transfer for payment or upload to ad-funded download portals — the contractual penalty amounts to EUR 30,000 per distributed work.

The statutory rules on defects for digital products (secs. 327 et seq. BGB) apply to member content and to individually purchased assets. During the supply period we provide the updates required to keep the content in conformity and announce them on this site. Missing compatibility with game versions, maps or third-party mods that were not stated as supported at the time of contract is not a defect.

Free mods are provided without charge; the statutory rules for digital products supplied free of charge apply to them.

We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, and under the German Product Liability Act. In cases of slight negligence we are liable only for the breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this kind of contract. Any further liability is excluded.

An account is enough to post; a membership is not required. You are responsible for what you write. You grant us the right to display it on this site permanently — you do not give up the rights to your text.

Not acceptable: abuse, advertising, sharing mod files outside this site, and unlawful content. We may hide individual posts, close threads, and in serious or repeated cases suspend an account.

You can report unlawful content using the report button on any post. That is our notice-and-action mechanism under Article 16 DSA; we review every report and decide traceably.

Partner-creator mods remain their intellectual property. Listing them here happens only with their consent (see the Partners page).

German law applies. If you are a consumer, the mandatory protective provisions of the state of your habitual residence remain unaffected. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board; the fastest way to reach us is by email.

We announce changes to these terms to signed-in users with reasonable notice by email or a notice on the site; for memberships already running, the version in force at the time of contract applies.
